By using this site, you confirm that you have read and understood the terms of use and that you agree to comply with them at all times.

We kindly ask that you carefully read the following terms and conditions, as they are binding between you and the Merchant, the owner of the Site. Furthermore, by doing so, you agree to communicate with the Merchant electronically for all your interactions and acknowledge that such communications meet the requirements of written communication.
We reserve the right, at our sole discretion, to refuse service, cancel an order, close your account, remove or edit Site content, or cancel an order whether or not you have complied with these Terms and Conditions.

The products and services offered are intended to be sold to adults of legal age in your place of residence, which is 18 years old in the province of Quebec. By using the Merchant’s Site, you represent and warrant that you have reached the legal age of majority in your place of residence.
Accuracy of Information
We do our best to ensure all information displayed on our Site is accurate, but we cannot guarantee this. We may refuse or cancel an order containing an item with an incorrect description or pricing. Unless otherwise stated, prices are listed in Canadian currency.
The products offered on our Site, as well as offer dates, prices, availability, characteristics, and technical specifications, are subject to change without notice. A product ordered online may become unavailable in our inventory or undeliverable due to circumstances beyond our control. If this is the case, the order will be canceled, and any amounts paid will be refunded.
Your only recourse in case of a product description mismatch is to return it in its original packaging for a refund, in accordance with the applicable refund policies outlined below.

The goods offered are works of art.
The goods covered by this document are those displayed on our site at the time of your visit. All descriptions, images, and information we provide about our goods are presented as accurately as possible.
Payments
We accept the following payment methods on this site:

• PayPal and Credit Card
By providing us with your payment information, you confirm that you have authorized the use of the selected payment method.
If we believe your payment has violated any law or any of our terms of use, we reserve the right to cancel your transaction.
Order Errors
If you believe an error occurred during your order placement, please notify us promptly, but no later than forty-eight (48) hours after discovery, by sending an email to: dianefournierart@gmail.com, clearly describing the error.
Shipping and Delivery
Shipping is free within Quebec. For elsewhere in Canada, the U.S., and internationally, shipping costs will be calculated by the artist based on the weight and dimensions of the artwork. This information will be provided before shipment for your approval.
The delivery method, carrier name, and estimated delivery time will be determined and communicated to you by the Merchant.
We commit to delivering your purchases within a reasonable time frame, subject to the availability of the carriers used by the sender, who are solely responsible for delivery.
The risk of loss and ownership of the purchased goods transfers to you when the item is handed over to the carrier, or, if crossing an international border, after customs clearance.
When making a purchase on our site, you agree to provide a valid email address and shipping address. We reserve the right to modify, reject, or cancel your order whenever necessary. If we cancel your order after payment has been processed, you will be refunded the full amount paid. You agree that it is your responsibility to monitor your payment method. While we strive to provide accurate shipping estimates, delivery times and costs may vary due to unforeseen circumstances.
Cancellation, Termination, Return, and Refund Policy
You may cancel an order if the product is not suitable. In that case, you must inform us of the issue prompting cancellation within forty-eight (48) hours of discovering it, by sending an email to: dianefournierart@gmail.com and first obtaining consent for cancellation.
You may request a refund if a product does not meet your expectations. In this case, you must notify us of the issue within forty-eight (48) hours of receiving the product and first obtain authorization for a refund. Then, if required by the Merchant, return the item as follows:

For postal returns, please package the products securely and ensure the original packaging is used.
Return shipping costs are not covered by us.
In all cases where a merchandise return is required by the Merchant, ownership of the returned item transfers to the Merchant only once the item has been received at their physical place of business.
Warranties
Limitation of Liability: Once the artwork is received and accepted, the artist is no longer responsible for any damage caused by handling, installation, storage location, or storage temperature.
Diane Fournier will be held responsible for any problems arising from this site. However, Diane Fournier is not responsible for any issues resulting from irregular use of the site.
Indemnification
As a user, you hereby indemnify Diane Fournier from any liability, cost, cause of action, damage, or expense arising from your use of this site or your violation of any of the provisions outlined in this document.
Applicable Laws
This document is subject to the applicable laws of Canada and is intended to comply with all necessary rules and regulations.
For EU residents, the GDPR (General Data Protection Regulation) is the applicable law governing this document. In the event of any inconsistency between a provision of this document and the GDPR, the GDPR rules shall prevail.
Severability
If at any time any provision set forth in this document is found to be inconsistent or invalid under applicable laws, such provision shall be deemed void and will be removed from this document. All other provisions will not be affected by the laws and the remainder of the document will continue to be considered valid.
